"For residential tenancy disputes (rent arrears, contested repair bills, or deposit release), accredited civil mediation resolves the disagreement within one month through a binding payment plan or mutual departure agreement. Homologated by the Justice of the Peace, this agreement holds the exact same executive force as a court ruling and is frequently 100% covered by legal expenses insurance."

Navigating tenancy agreements and lease disputes in Belgium

Frequent tenancy friction points

Tenancy relationships can deteriorate rapidly when unexpected life events or maintenance disputes arise:

Rent arrears and payment schedules

Agreeing on realistic installment plans preventing unmanageable debt accumulation and formal eviction proceedings.

Rental deposit release

Distinguishing fair wear and tear from tenant damage based on the move-in and move-out inspection reports (*état des lieux / plaatsbeschrijving*).

Property maintenance and repairs

Clear statutory breakdown between owner responsibilities (major repairs, roof, heating systems) and tenant maintenance duties.

Early termination

Negotiating amicable notice periods and replacement tenants without punitive indemnities.

Legal expenses insurance coverage

In Belgium, comprehensive home insurance policies (assurance habitation / brandverzekering) and legal protection covers usually reimburse accredited mediation fees for landlord-tenant conflicts.

This enables both parties to resolve the dispute without financial hardship or the risk of adverse legal cost orders.
