At conflicool, we are deeply convinced that mediation is the best way to reach an agreement
in many conflict situations. We are also
convinced that it is important to accompany the disputant (Believing that not every dispute should be dealt with in justice, we prefer the term dispute - invented by us - to justiciable, which induces the idea that only justice can resolve conflicts) in the search for the appropriate mediator so that he may begin this process in the most serene manner possible. This is why at conflicool we wish to propose a disruptive approach to the current offer of mediation, putting the dispute and not the search for the mediator at the centre of our concerns

By seeking to reach a deep understanding of the dispute between one or more parties, conflicool wishes to offer its users the most suitable solution in order to easily and quickly reach an agreement capable of satisfying all the
parties

To achieve this, it is essential that mediators who register on conflicool are committed to offering the best possible support to the dispute.

The mediator's role

The accredited mediator is an essential element in the success of a mediation process. In order to guarantee appropriate support for the dispute, our mediators are committed to training throughout their professional practice in order to maintain their accreditation and be able to respond effectively to the requests of conflicool users.

They also undertake to respect the ethical and confidentiality rules of the profession, as well as to duly fill in their mediator profile on conflicool and to communicate to us any eventual modification concerning their status as mediator.

The conflicool mediators also undertake to call on mediation advice when necessary, for example when drafting the mediation agreement in case the mediator is not a lawyer himself.

And in order to welcome disputes in good conditions, the mediators who register on conflicool undertake to offer a warm meeting place with adequate furniture and equipment.

Mediators' commitments to conflicool

In order not to compromise the development of conflicool, our mediators undertake not to use our platform to their advantage and not to offer mediation outside the platform to disputes encountered via conflicool.

They also agree not to assist a party or parties to the dispute - unless this was already the case beforehand - as a lawyer or expert in the dispute, even at the express request of one of the parties.

conflicool can obviously not exist without the active participation of its mediators. The mediators therefore undertake to contribute to the operation and development of the platform through a membership fee per mediation.

The mediation process

The smooth running of mediations started on conflicool can only be guaranteed with the full participation of the mediators. In order to ensure the fast resolution of
conflicts, our mediators undertake to respond within 2 calendar days to any new request for mediation on conflicool. Of course, any mediator has the right to refuse a
mediation that is offered to him.

By joining conflicool, our mediators agree to offer our users a free initial meeting by videoconference on conflicool during which they inform them in complete transparency about the possibility of settling their conflict through mediation, how it will be handled and the fees charged by conflicool. Disputants can then enter into mediation in full transparency
tranquility.

At the beginning of each mediation started on conflicool, our mediators also inform us within 2 calendar days of the signature of a mediation protocol. It is the same for the signature or not of a mediation protocol
of the mediation agreement at the end of the procedure.

Contribution to the improvement of conflicool

Finally, at the end of each mediation and in order to participate in the constant improvement of our platform, our mediators undertake to stimulate the feedback of disputes to conflicool in order to submit testimonials and/or make suggestions for improvement.

conflicool will also collect certain data about the mediation process, in order to make a feedback to the mediator. In addition, the mediator will be asked to provide, on an anonymous and confidential basis, for further processing for statistical purposes, certain data on the mediation process such as duration, cost and outcome of the procedure.
